Its 16 here in Kentucky as well, but 18 is the cut off point for me considering that is when you're legally considered an adult. This is incorrect. The age of consent is the age at which you are declared legally competent to give consent to an adult (21 I think). Statutory rape only comes into play when one (and only one) of the two people is under that age. If both are at or over the age of consent, there is no statutory rape.
In this context, she is underaged, regardless of the age of consent. My rule is, if the person cannot get into an age gated porn site without lying, they are not able to produce the content at all.
If we are going to argue legality as well, I do wish to cite "The United States vs Stephen Knox," a case which declared content produced with persons that included 17 year olds, illegal and nondefensible. In this case, the producer of the content stated the ages, and the consumers defense was that he was not aware, due to the producer's statement was that the content was "perfectly legal."

The court ruled that this kind of content wasn't legal. There is no excuse here either, given the reason for the content and what it is.
