I'm surprised about the Dailymotion thing, more so because of the supposed reason. The place is creaking at the seams with content people post up that isn't theirs.

I wonder if the policy is to generally let things be, but they have to take action if there's a complaint. In that case I'd be more that a little suspicious about who might have done that and why...

Dailymotion seems pretty good to me for what they allow, so I'd say take it up with them and see if they'll put it right, since some of the content even in the promos falls foul of Youtube.

I'd be more than a little inclined to pursue the matter, since it seems less likely they would work on that assumption unless someone deliberately misled them. If so, there may some grounds for further action.

Also, if someone did do that, I'd like to know who, and if they were complaining to Youtube as well.

We've followed up and then some especially when sometimes it takes a few days to get our full length clips that people post removed but somebody can lie and have our entire channel deleted so easily.
We want the videos that were removed put back up with the same stats they had when they were taken down otherwise we probably won't bother starting over again since a minuscule number of actual customers ever discover us there. But the DailyMotion people still want more proof we owned them in the first place. Nothing we have provided has been good enough.

Unbelievable. The layout at DM is pretty good and I suspect that it's yet to achieve wider popularity.

I've seen a few tell Youtube where to stick it and then go there instead. But if this sort of nonsense is going to happen then it might not be like this for long.

Perhaps a letter from yourself or a lawyer along the lines of (but not exactly):

- Suggesting they promptly explain why they will accept no clear proof of ownership nor be more forthcoming about why, or what they would consider satisfactory.

- Why it is that even though you are fine with being asked to provide whatever information they could possibly need, they still appear to be clearly determined to ignore it, despite having taking their action based on pure hearsay, this being self-evident due to the legally provable facts to the contrary.

- Alternatively, they might prefer to answer these matters in court, where on the basis of the simple and indisputable evidence that the content is yours, they will most certainly be gleefully ass-raped by your counsel for some such damages as loss of trade or any other possible or probable damage to your business that can be flung at them for not just (or even so much) their original action without any reasonable or due process, but their continued lack of co-operation. Not to mention anything else they can dream up over a hearty lunch.

For the sake of a simple letter with the right letterhead, it might not be too much trouble if they then decide to either at least be more communicative, or better still, comply with your above request.

I'm sorry I missed this post somehow.

After I bothered them enough times they finally said...
"Please to settle that matter once and for all, if you have any rights on videos , please send us any agreement you may have. Plus you can ask to be official user, as it was already suggested. Thanks"

So I sent them everything I could think of that would prove that I owned those videos AND I applied to be an "official user".
Since then I have received no response from DailyMotion nor did I get any replies to my emails about getting no response. I'm essentially being totally ignored except when I submit takedown requests for my full length videos being posted(jmassi--Grow up & then Go Fuck Yourself) which they honor and usually remove the videos within a couple days.
Go figure.

I know who sent the fraudulent takedowns and I supplied them with proof of that as well. I showed them where the identically worded takedowns were used to get other legally posted content of mine illegally removed from sites like Youtube and Metacafe. The person didn't even claim to be representing TaylorMadeClips but some other producer altogether with no affiliation to us at all but they still took down our entire channel in less then 24 hours.

When Youtube removed the videos I contacted them and after a brief explanation they put them back up and have ignored any subsequent takedowns that don't come from me.

Honestly speaking suit inflation videos do not sell very well numbers wise but you could never guess that based upon the support we get for them. It seems like 50% of the people that buy a suit clip make a post somewhere about it. That kind of positive support/feedback is why we continue to make them.

I would ask Brian at Kinky King. He can tell you all you need to know to take care of your suit. His company made it after all... I did also ask him about the "limits" of a suit like that (I have one too) and if he has ever done any "failure" testing. He has said that he has not and due to the expense probably would not intentionally test one to failure. I'm not asking you to push it that far, but if you should really push it and have a "failure" of your suit, I'm sure he would like the video (I'd like to see it too :-). Keep up the good work and I am one of the few that like suit inflation videos (clothed or not) and do regularly post when I see a good one!
